The Kaipara District Plan

The Kaipara District Plan (‘the District Plan)’ was notified as the Proposed District Plan in 2009, and became the Operative District Plan on 1 November 2013.

The District Plan explains how the Council will manage the environment. It sets out what activities you can do as of right (permitted activities), what activities you will need resource consent for, and how certain activities may be carried out. It covers things like:

  • Residential development
  • Noise
  • Location and height of buildings
  • Natural hazards and the management of hazardous substances
  • Protection of indigenous vegetation
The District Plan is prepared by the Council in response to its obligations under the Resource Management Act 1991. The District Plan includes:
  • Objectives
  • Policies; and
  • Methods (including Rules)

To achieve the integrated and sustainable management of the effects of use, development or protection (as appropriate) of land, and the natural and physical resources of the District.

The Resource Management Act

The purpose of the Resource Management Act 1991 (Section 5) is to promote the sustainable management of natural and physical resources. The Act defines sustainable management as ‘managing the use, development and protection of natural and physical resources in a way, or at a rate, which enables people and communities to provide for their social, economic and cultural wellbeing, and for their health and safety while:

  1. Sustaining the potential of natural and physical resources (excluding minerals) to meet the reasonably foreseeable needs of future generations; and
  2. Safeguarding the life-supporting capacity of air, water, soil and ecosystems; and
  3. Avoiding, remedying or mitigating any adverse effects of activities on the environment’

The Act defines ‘natural and physical resources’ as including:

land, water, air, soil, minerals and energy, all forms of plants and animals (whether native to New Zealand or introduced) and all structures
