Food Premises

Before you open a new food business

You will need:

  • a current Certificate of Registration, required under the Food Hygiene Regulations 1974

  • to obtain food safety training to an appropriate level that complies with the Food Hygiene Bylaw 2008.

If you are constructing a new building or converting or changing the use of an existing building, you may need both resource and building consents before you start any work on the site.

We recommend that you discuss your proposal with Council staff early to establish the various legal requirements you will have to comply with. Bring your site plans, building plans and business details with you when you do this.

Selling or supplying liquor

If you intend to sell and supply liquor as part of your business, you will require a Liquor Licence under the Sale of Liquor Act 1989. The type of licence will depend on the type of business you intend to operate. Please refer to Health Licence Fees section for the correct description and category.

The annual food registration may be exempt provided that you are registered under the New Zealand Food Safety Authority Voluntary Implementation Programme.  For further details contact the Environmental Health Officer on 09 4304101 Ext 7878.  An annual audit will still be required.

 

Mobile Shops

The description of a mobile shop falls into four categories:

  1. A vehicle whether self propelled or not, standing in or on a road and from which fruit and vegetables are offered or exposed for sale and does not include the consumption of food in or at the vehicle.  This licence will also cover mobile coffee shops.
  2. A vehicle whether self propelled or not, standing in or on a road and from which pre-packaged non‑perishable foods only are offered or exposed for sale and does not include the consumption of food in or at the vehicle.
  3. A vehicle whether self propelled or not, standing in or on a road and from which food preparation on site for the purpose of selling are offered or exposed for sale and does not include the consumption of food in or at the vehicle.
  4. Where current mobile shop licence provided from another territorial authority (conditions apply)

Hawkers, Stalls and Itinerant Traders

Hawkers – Include any person who carries out or takes about any goods, wares or merchandise, for sale or hire not in response to any invitation to call and goods carried about by that person, does not trade directly from a vehicle.

Itinerant Traders – apply to any person who has been a non-resident in the district for six months prior to the application date; not owning or having entered into a binding lease in writing in the district for at least six months; carries on or engages in any business in the district involving the sale or hire of goods.

Stand or Stall Traders – includes a stand, stall structure or contrivance from which any goods, merchandise or service if offered for distribution or sale and which is erected, placed or maintained in or on a public place.

One Day Events

Guide to Sell, Serve or Supply Food at Special Events.  No fee payable.

Any events such as galas, sausage sizzles, cake stalls; any event which involves food (also including food which has not have been prepared in a commercial kitchen).

  • Audit fees for premises subject to Food Control Plan: $98.00 per hour in addition to travel time and mileage for the auditor.
  • All categories of premises are checked each year by staff in conjunction with the Environmental Health Officer.

 

Other Licence Fees with Annual Fee

Mobile Shop

A vehicle whether self propelled or not, standing in or on a road and from which pre-packaged non-perishable foods only are offered or exposed for sale and does not include the consumption of food in or at the vehicle  $410.00

A vehicle whether self propelled or not, standing in or on a road and from which food preparation on site for the purpose of selling only are offered or exposed for sale and does not include the consumption of food in or at the vehicle $700.00

Where current mobile shop licence provided from another territorial authority (conditions apply) $90.00

Itinerant Traders

Not a resident in the District for six months prior to the application date; not owning or having entered into a binding lease in writing in the District for at least six months; carries on or engages in any business in the District involving the sale or hire or exposure for sale or hire of goods.

Per Occasion $120.00

Hawkers

Includes any person who carries or takes about any goods, wares or merchandise, for sale or hire not in response to any invitation to call and goods carried or taken about by that person, does not trade directly from a vehicle. Per Occasion $30.00

Stand or Stall Traders

Means a stand or stall structure or contrivance from which any goods, merchandise or service is offered for distribution or sale and which is erected, placed or maintained in or on a public place. Per Occasion $20.00

 

Other Related Fees

  • Annual Fee Re-inspection Fee as charged to Council plus 10%
  • Transfer of Licence Fee when business is sold or transferred to another name $50.00
  • Duplicate Licence Fee in the event of the loss or damage to existing licence $30.00
