The former District Plan was adopted in 1997 and was therefore under the Resource Management Act to be reviewed in 2007. The Council determined that the 1997 District Plan was not delivering appropriate environmental and development outcomes. This resulted in a review process, which saw the Proposed District Plan notified in 2009. This was followed by the First Schedule of the RMA process, which includes the need for submissions, further submissions, hearings and decisions. 

Following the release of the Decisions, eighteen appeals were lodged with the Environment Court. All of these were settled by way of Consent Order, and the Kaipara District Plan was made Operative on 01 November 2013.

APPEALS & CONSENT ORDERS

Following the notification of the Council's decisions on the Proposed District Plan, eighteen appeals were lodged with the Environment Court. These appeals went through the Environment Court process of mediation, and all appeals were resolved by way of Consent Orders. VARIATION 1 TO THE PROPOSED DISTRICT PLAN

The Resource Management Act 1991 gives the Council authority to change or vary its District Plan to carry out its functions under the RMA. Where a District Plan is 'proposed', any change to the District Plan in that state is called a 'Variation'. A Variation allows Councils to change or amend the District Plan to include new provisions or information. In this case, Variation 1 was the first (and only) Variation to Kaipara District Council's Proposed District Plan. 
Why did Council notify a Variation to the Proposed District Plan?  The Proposed Kaipara District Plan, when notified in October 2009, had a blank Chapter 18 (Landscapes). This was in response to a Council resolution to place the development of the chapter 'on hold', in order to concentrate the Council's limited resources on other key strategic elements of the District Plan review. This conclusion was highlighted in the s32 report released with the Proposed District Plan in 2009. 

Hearings on the Proposed District Plan were completed in August 2010, and a number of submissions were received relating to the provisions of a Landscapes chapter. Council signalled its intention at a Council meeting in April 2010, that following the hearing of submissions, it would proceed to finalise and notify a variation to the Landscapes Chapter in September 2010. This was confirmed by Council resolution following the close of hearings on the Proposed District Plan. 
Declaration Proceedings The Environmental Defence Society (EDS) sought a Declaration from the Environment Court on the 'missing chapter' of the Proposed Kaipara District Plan. The Council sought an extension of time from the Environment Court to allow further work still being progressed by Council to be included in Variation 1. 

On 10 November 2010, the Environment Court issued an Interim Decision, stating: 
'The variation is best, therefore, notified forthwith in its current form, with Council's submission, and/or a replacement variation and/or a variation on the variation to follow
Variation 1 Variation 1 to the Proposed District Plan sought to identify outstanding natural landscapes and to protect these landscapes from inappropriate subdivision, use and development. Examples of these Outstanding Natural Landscapes (ONLs) include Tokatoka, the West Coast, and the Brynderwyns. There was a fact sheet and newsletter produced on Variation 1 to assist residents with understanding what the Variation meant to them, and the Proposed District Plan. 

Variation 1 was notified in December 2010, with the submissions period closing on 28 February 2011. Council received approximately 550 submissions. Further submissions closed on 7 June 2011, and there were 56 further submissions received. Hearings were held from 29 November - 8 December 2011, and closing addresses were heard on 22 December 2011. 

A Decision was released on 6 July 2012, with eight appeals subsequently being lodged with the Environment Court. Court-assisted mediations occurred through late 2012, and seven appeals were resolved in their entirety through Consent Orders. One remaining appeal point progressed to an Environment Court hearing, and this was resolved by Decisions of the Court in 2014. 

The remaining appeal point, as resolved by Environment Court Decision, was made Operative on 01 June 2017.
