Appeals to the Proposed Kaipara District Plan

 

Eighteen Appeals have been lodged with the Environment Court to the Proposed Kaipara District Plan.  Council is currently in Council assisted mediations with appellants.

 

The Appeals Version District Plan is now complete.  Parts of the Appeals Version Plan are now operative, because no appeals have been lodged against them.  These provisions replace the equivalent provisions in the old District Plan.  The Appeal Version Plan also shows which provisions are subject to an appeal.  This means they will still be considered when determining if you need a Resource Consent or not, but may be given little weight when the Resource Consent is determined and the equivalent provision in the old Operative Plan may be relied upon.

Update on Appeals Mediation - Proposed District Plan & Variation 1


Council has undertaken Court dissisted mediations with appellants.  Mediations have gone well and it is expected that most appeals will be able to be settled out of Court. Consent orders have been signed on some topic, with work progressing well on the remaining appeal topics.

An appeals version of the Variation will be released once the appeal period  has finished and the Variation is annotated so as to show which provisions have been appealed.  Those rules within the Decisions version of the Variation that are not appealed become fully operative.

 


Revised Engineering Standards


Council's Engineering Standards are a reference document to the Kaipara District Plan. The District Plan in one of the main 'triggers' for when the Engineering Standards must be complied with. The Engineering Standards 2009 were reviewed as a result of submissions to the Proposed District Plan. One aspect of that review was to reconsider how the two documents, the Standards and the Plan, relate and refer to each other. It was decided that most engineering matters would be retained as a reference to Council's Engineering Standards in the Matters of Assessment within the District Plan, rather than incorporated within the rule itself. However, for those aspects of the Standards that are relevant to efforts on the environment, then they would be incorporated within the rule itself, for example vehicle crossings. The updated Engineering Standards 2011 and the Decisions version District Plan both reflect these changes.
